Terms of Service

By accessing or using QleadAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

QleadAI is a marketing automation platform that provides:

• Multi-channel campaign management (email, SMS, social media)
• AI-powered content generation
• Contact and segment management
• Marketing analytics and reporting
• Workflow automation

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4.1 Free Trial

We offer a 14-day free trial for new users. At the end of the trial period, you will need to subscribe to a paid plan to continue using the Service.

4.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly basis. You agree to pay all fees associated with your selected plan. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated at least 30 days in advance and will apply to the next billing cycle.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial months.

You agree not to use the Service to:

• Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, GDPR, POPIA)
• Transmit malware, viruses, or other malicious code
• Harass, abuse, or harm another person or entity
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Collect or store personal data of others without proper consent
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to systems or networks
• Use the Service for any illegal or unauthorized purpose

When using our email and messaging features, you agree to:

• Only send messages to recipients who have given consent (opt-in)
• Include accurate sender information and physical address
• Provide a clear and functional unsubscribe mechanism
• Honor unsubscribe requests within 10 business days
• Maintain records of consent for all recipients
• Comply with all applicable anti-spam laws in your jurisdiction

Violation of these requirements may result in immediate termination of your account without refund.

7.1 Our Property

The Service and its original content (excluding content provided by users), features, and functionality are owned by QleadAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you upload, create, or share through the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Service.

7.3 AI-Generated Content

Content generated by our AI features is provided "as is." You are responsible for reviewing and editing AI-generated content before use. You retain ownership of the final content you create using our AI tools.

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

As a data processor, we will process personal data on your behalf in accordance with your instructions and applicable data protection laws.

9.1 Uptime

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with reasonable advance notice.

9.2 Support

Support is provided via email and our help center. Response times vary based on your subscription plan. Enterprise customers receive priority support with dedicated account management.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QleadAi SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

You agree to indemnify, defend, and hold harmless QleadAI and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is harmful to our business interests

Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination, after which it may be deleted.

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the Arbitration Act of South Africa, except where prohibited by law.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
